1. Agreement to these terms
These Terms of Service (the "Terms") govern your access to and use of VirtualAssistant SG and the AI assistant known as Ah Va (together, the "Service"), available at www.virtualassistant.com.sg. The Service is operated by Best Marketing Agency Pte Ltd, UEN 201936773M, a Singapore-registered company ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. What the Service does
Ah Va is an AI virtual assistant that answers phone calls and WhatsApp calls, replies to WhatsApp messages, books appointments, captures leads, and follows up with your customers on your behalf, based on the business information and instructions you provide. The Service is provided to businesses for their commercial use.
3. Your account
You must provide accurate information when you sign up and keep it up to date. You are responsible for activity under your account and for keeping your login secure. You must be authorised to act for the business you register.
4. Acceptable use
You agree not to use the Service for anything unlawful, deceptive, or harmful, and not to use it to send spam, harass, or impersonate others. You agree not to attempt to break, overload, reverse engineer, or gain unauthorised access to the Service. We may suspend or terminate accounts that breach this section.
5. Your responsibilities and consent
You are responsible for the content and instructions you give Ah Va and for ensuring they are accurate and lawful. Where Ah Va records or transcribes calls, or stores messages, you are responsible for giving any notice and obtaining any consent required from your callers and customers under Singapore's Personal Data Protection Act (PDPA) and any other applicable law. You appoint us to process that data on your behalf in order to provide the Service.
6. Fees, billing, and cancellation
Paid plans are billed in advance on a recurring basis at the prices shown on our pricing page, in Singapore dollars. Card payments are handled by our payment processor, Stripe; we do not store full card numbers. Usage above an included allowance may incur additional charges as described on the pricing page. You can cancel at any time, effective at the end of the current billing period. Except where required by law, fees already paid are non-refundable.
7. AI has limits
Ah Va is automated software and can make mistakes, mishear, or give incomplete answers. The Service does not provide medical, legal, financial, or other professional advice, and must not be relied on as such. You are responsible for reviewing important outcomes (such as bookings and quotes) and for decisions made based on the Service.
8. Data and privacy
How we handle personal data is described in our Privacy Policy. You can ask us to delete data as described on our Data Deletion page.
9. Intellectual property
We own the Service, including its software, design, and brand. You keep ownership of your own business content and customer data. You grant us the limited right to use that content only to operate and improve the Service for you.
10. Third-party services
The Service connects to third-party tools you choose to enable, such as WhatsApp, Google Calendar, and your CRM, and it relies on third-party AI, voice, and communications infrastructure to function. Your use of those third-party tools is also subject to their own terms. We are not responsible for third-party services that we do not control.
11. Availability
We work to keep the Service available and reliable, but we provide it on an "as is" and "as available" basis, without warranties of any kind to the extent permitted by law. We may change, suspend, or discontinue features, with reasonable notice where practical.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential losses, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the fees you paid us for the Service in the three months before the event giving rise to the claim.
13. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if required by law. On termination, your right to use the Service ends; sections that by their nature should survive (such as fees owed, intellectual property, and limitation of liability) continue to apply.
14. Changes to these terms
We may update these Terms from time to time. The "Last updated" date at the top of this page shows the current version. Continued use of the Service after a change means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute relating to them.
